Terms of Service

1. Acceptance of Terms
By creating an account, accessing, or using TryOnCloud (the "Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms apply to all users, including merchants integrating via Shopify, WooCommerce, custom API, or any other method. If you do not agree to these Terms, do not use the Service. TryOnCloud reserves the right to update these Terms at any time; continued use of the Service after changes constitutes acceptance.
2. Description of Service
TryOnCloud provides an AI-powered virtual try-on API that allows e-commerce merchants to enable their customers to see how clothing products look on a person's photo. The Service includes:
- A REST API for virtual try-on image generation
- A Shopify App for direct store integration
- A WooCommerce Plugin for WordPress-based stores
- A merchant dashboard for managing API keys, usage, billing, and settings
- A Super Admin panel for platform administration
- Documentation, tutorials, and support resources
3. Accounts & Registration
- Eligibility: You must be at least 18 years of age and have the legal authority to enter into a binding contract to use TryOnCloud.
- Account Security: You are responsible for maintaining the confidentiality of your account credentials and API keys. You must notify us immediately of any unauthorized access or use of your account.
- Accurate Information: You agree to provide accurate, current, and complete information during registration and to keep this information up to date.
- One Account Per Entity: Each business or individual may maintain only one account unless expressly authorized by TryOnCloud in writing.
- API Key Responsibility: Your API key is tied to your account and plan. You may not share, sell, or transfer your API key to any third party. You are responsible for all usage that occurs under your API key.
4. Plans, Billing & Payments
- Free Plan: TryOnCloud offers a Free Plan with 20 virtual try-on generations per month. No payment information is required for the Free Plan.
- Paid Plans: Paid subscriptions (Starter, Professional, Enterprise) are billed monthly or annually in advance. All prices are listed on our Pricing page and are exclusive of applicable taxes.
- Automatic Renewal: Paid subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date from your account dashboard.
- Price Changes: TryOnCloud may modify plan pricing at any time. We will provide at least 30 days' notice before any price increase affects existing subscribers.
- Taxes: You are responsible for all applicable taxes, duties, and levies imposed by your local government on your subscription fees.
- Failed Payments: If a payment fails, we will retry up to 3 times. If payment continues to fail, your account may be downgraded to the Free Plan until billing is resolved.
5. Acceptable Use Policy
You agree not to use TryOnCloud in any way that:
- Violates any applicable local, national, or international law or regulation
- Processes, uploads, or generates images of a sexual, exploitative, or harmful nature
- Impersonates or misrepresents your affiliation with any person or entity
- Circumvents or attempts to bypass API rate limits, usage quotas, or authentication mechanisms
- Reverse engineers, decompiles, or attempts to extract source code from our API or SDKs
- Scrapes, harvests, or systematically extracts data from TryOnCloud without written permission
- Resells or sublicenses API access without an explicit reseller agreement with TryOnCloud
- Introduces malware, viruses, or other harmful code into the Service
- Disrupts or interferes with the integrity or performance of the Service
- Processes images of real people without their consent
Violation of this policy may result in immediate account suspension or termination without refund.
6. Intellectual Property
- TryOnCloud IP: All rights, title, and interest in and to the TryOnCloud platform, API, brand, trademarks, and underlying technology remain the exclusive property of TryOnCloud. These Terms do not grant you any ownership rights.
- Your Content: You retain full ownership of the product images and person photos you submit to the API. By submitting content, you grant TryOnCloud a limited, non-exclusive license to process that content solely for the purpose of providing the Service.
- Generated Output: AI-generated try-on images produced by the Service using your inputs are owned by you for use in your e-commerce store. TryOnCloud may use anonymized, aggregated outputs for model improvement only.
- Feedback: Any feedback, suggestions, or ideas you provide about TryOnCloud may be used by us freely without obligation or compensation to you.
7. Third-Party Integrations
Shopify
Our Shopify App is subject to Shopify's Partner Program Agreement and App Store policies in addition to these Terms. By installing our Shopify App, you authorize TryOnCloud to access your store's product data, theme, and necessary APIs to provide the Service. We request only the minimum permissions necessary.
WooCommerce
Our WooCommerce Plugin operates within your WordPress environment. You are responsible for maintaining a compatible server environment (WordPress 5.8+, WooCommerce 6.0+, PHP 7.4+). TryOnCloud is not responsible for conflicts arising from incompatible themes, plugins, or server configurations.
Custom API
When using our REST API directly, you are responsible for implementing secure API key storage, HTTPS-only communication, and proper error handling in your application. TryOnCloud provides documentation and support but is not responsible for your client-side implementation.
8. Privacy & Data
Your use of TryOnCloud is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of data as described in the Privacy Policy. As a merchant, you are responsible for obtaining appropriate consent from your end-users for any images processed through the API.
9. Service Level & Uptime
TryOnCloud targets 99.5% monthly uptime for paid plans. Scheduled maintenance windows will be communicated at least 24 hours in advance via email and our status page.
- Free Plan: Best-effort availability, no uptime SLA.
- Starter & Professional: 99.5% monthly uptime target. Service credits may be issued for verified downtime exceeding 48 hours.
- Enterprise: Custom SLA terms available on request.
10. Disclaimers & Limitation of Liability
- As-Is Service: The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
- AI Accuracy: Virtual try-on results are AI-generated estimations. TryOnCloud does not guarantee that generated images will perfectly represent how a garment fits or looks on any individual. Results may vary based on photo quality and garment type.
- Liability Cap: To the maximum extent permitted by law, TryOnCloud's total liability to you for any claims arising under these Terms shall not exceed the total amount you paid to TryOnCloud in the three (3) months preceding the claim.
- Indirect Damages: TryOnCloud shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities.
11. Termination
- By You: You may cancel your account at any time from your account dashboard. Cancellation takes effect at the end of the current billing period.
- By TryOnCloud: We may suspend or terminate your account immediately for violation of these Terms, illegal activity, fraudulent use, or any conduct that we determine is harmful to TryOnCloud or its users.
- Effect of Termination: Upon termination, your access to the Service and API key will be revoked. Data will be retained and deleted per our Privacy Policy. You remain responsible for all charges incurred prior to termination.
12. Governing Law & Disputes
These Terms are governed by and construed in accordance with applicable law. Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration or the competent courts as applicable in your jurisdiction. EU and UK consumers retain their statutory rights under local consumer protection laws.
13. Changes to These Terms
TryOnCloud reserves the right to modify these Terms at any time. We will provide notice of material changes by email and by updating the "Last updated" date on this page. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree with the changes, you must cancel your account before the effective date.
